Repetitive Stress Injuries Can Be Serious
From John’s interview for the Masters of Workers’ Compensation series on ReelLawyers.com.
If a repetitive stress injury has made it impossible to do your job, now is a time when you could benefit from a consultation with an experienced workers’ compensation attorney. In North Carolina, workers’ compensation may or may not cover repetitive stress type injuries. Workers’ compensation rules are complicated, and if you make a mistake, the insurance carrier could deny your claim.
At Ayers, Whitlow & Dressler in Charlotte, North Carolina, our lawyers are skilled at helping injured workers show that their work injury or occupational disease is covered. We offer a free initial consultation to discuss your case.
Talk To Our Attorneys First
A repetitive stress injury is the result of performing work activities, such as hand motions or lifting, over a period of time rather than a single work accident. An example is carpal tunnel syndrome.
In North Carolina, injuries caused by performing regular work duties are generally not covered. There are exceptions such as back injuries and hernias. An occupational illness caused by repetitive stress may also be covered if you can show:
- Your job environment was a contributing factor to developing the repetitive stress injury.
- Your job environment placed you at a greater risk of developing the repetitive stress injury than the general public.
- The occupational disease is peculiar to or characteristic of the trade involved.
It often takes a lawyer’s help to receive workers’ compensation benefits for health conditions caused by repetitive stress.
If your repetitive stress injury prevents you from working for a year or longer, you may also qualify for Social Security Disability. Our lawyers can coordinate your workers’ compensation and Social Security Disability claim to help you receive the maximum compensation you are due.
